Seeing as I am certified to sell tobacco and alchohol in Wisconsin per statutes 125.04, 125.17, and 134.66, (in case the ATF is watching) does anyone know what federal or state issues I would have to contend with to distribute to tobacco shops in the state? Take the mail-order out of the issue and it’s legal right? Now, technically, I have to also be approved by different villages to sell, and I highly doubt I’ll get that privledge in my home town again, allthough I still have it in La Crosse. What would it take to buy and sell? The tobacco shops around here I’ve spoken with have a hard time obtaining snuff even from liscensed distributers. I’ve got some strange liscenses; I.E. Crossbow, Guide, Seller / Server… making it legal to do what I did as a young dumb kid before I knew you needed liscenses. I wonder if this is something I can make money on, as cigars are out of question… Any advice would be appreciated, maybe it’s not worth it, but the thought is.
I wish someone in the know, with the know-how, would launch an American nasal snuff. Maybe start with 2, an SP, and a menthol. Get them legal, and have tobacco shops carry them.

There is no “ban” on internet orders, I really wish people would learn what the law really says. It seems that people are over governing themselves.

As a private consumer, as of now, I took what is written above as a fact, without researching it myself which is unlike me seeing as how I’m quite familiar with some areas of law. If I can, I’ll have my cousins look into it as I technically do have a sellers permit. I know I can order from the UK or elsewhere in world. I was happy to see my last order come in via Royal Mail plainly marked that it was snuff, with a customs stamp and all. As a tool-maker, union steward, buisness student, and with any luck a future J.D., I look forward to getting to know the variouse laws well. Anyone’s info that is selling to or from the USA would be GREATLY appreciated.

Tom(NicRush) stated he overstated that, more so in reference to his situation. I mentioned it when I read it. But that’s not the law. The law says one has to ship with UPS, and sign, and show an ID, and collect state taxes(not sure if this just pertains to US shops), and I think sell FDA app’ed items. But alot of this is confusing, because some shops do different things.
Tom is basically correct. Anyone with a tobacco license may sell, without harm, to any other tobacco dealer. (we’re talking US here. PACT does not apply to international sellers) A tobacco dealer may not ship to an out of state private individual, without first complying with PACT. I will soon know if I’m able to start shipping again.
Hi friends, Just want you to know I am still alive. I’ve had to deal with a lot of health issues this year all while taking care of my 95 year-old mother. I have been somewhat incapacitated. Right now I am recovering from an umbilical hernia operation. I had to have it done in Tijuana because it’s much more than I can afford to pay in the USA. So the snuff venture I was all excited about has had to take a lower priority. Tangiers Tobacco has move to the new location, and there is more room there for developing and producing snuffs. The rub is that without internet sales, I would need an army of sales reps to fan out and hit tobacco shops across the country. I know from personal experience, it’s a tough sale, given how few American sniff snuff, percentage wise. Frankly this is more than I could manage with everything else currently on my plate. I haven’t posted here for a while. I am a bit embarrassed by the whole thing. Tangiers finally moved to it’s new location -the grand opening of the hookah lounge two weeks ago. It’s much better and larger. There is some space there for new product development and production if I can find a wholesale market where we could generate enough $ to justify California permits - which cost plenty. Once I get back on my feet health wise, Eric and I will continue to play with this project, at very least for our own amusement. In time something may come to market, but don’t hold your breath. Without internet sales, it’s probably not a viable idea. I’m so sorry to get everyone’s hopes up.
I’m game to be a rep if you wish. I have state certs, but only municipal certs in my state. The biggest issue I see is the tax code. I am working on reading both by myself, and my “atty” (former layer cousing) the actual parts of the PACT Act. I’ve learned through my life in buisness expierience, and some H.R. and other law, how to actually read what is fact or not. I’m still working on finding the actual written part of the PACT Act. As of this point, all I’m finding are news articles pertaining to this issue. I have knowledge of different Native American issues, as my father worked for IHS for many years, and my step mother used to be the Tribal Administrator for the Lakota tribe in S.D., which are NON-Treaty indians, vs. the treaty indians involved with the Ho-Chunk Nation which is local to where I am now. I’m sure as N.R. Tom figures it out, he won’t be at risk for any convictions. As far as local trade, it would take a ton of marketing, as well as people to put money, along with there reputations and other things on the line, to take the risk of trying to turn people on to what has become a most lovely habit for me and some of my family and friends. @Stitch, These things take time and I understand completely about your issues as I used to take care of my elderly Grandmother and Aunt, and have also recently had a MAJOR neck surgery, along with my chronic pain and PTSD issues. You need not appologize to anyone; in my opinion. My local friend and I got shut our of cigar sales gig awhile ago, especially with Wisconsin’s recent ban on smoking in the workplace. (Which means bars, as bartenders work there.) It will take time, it’s just a matter of coming up with the right legal represtentaition, tobacco loby which I’m very familiar and on a first name basis with several Wisconsin poloticians that are in office, on both sides of the party lines. (Trap-shoot fundraisers, cigar parties, etc…) What I was looking for in this thread as I started it, was people who already had formal, educated, (as in legal) knowledge of the details. You have my condolences for everything you’ve been dealing with as of late. I can’t understand yet having to take care of my mother, as allthough I’m there for my mother, she’s only 67 and needs minimal help. I look up to you. Thanks for the well wishes, Mcguyver75. Although mother and I are not christian, your prayers for peace are welcome. Like you, I am tolerant of others beliefs and peace is good thing to ask for. Enough said. AS for becoming a rep, I do appreciate your interest and credentials . I would like to know more about how an alliance with a tribe may be used to circumvent some or all the regulations and roadblocks put up by state and local governments. There are many local tribes in San Diego County. PM me if you have any ideas you want to share along those lines, or otherwise.

In a couple minutes, after this cup of coffee, I’m off to discuss some federal and state regulations on the sale of snuff with my friend who manages a Record Shop / Head and Tobacco shop. I should learn some interesting things. She’s willing to put more snuff on sale; if she finds a supplier that will take care of the taxes for her, and can prove it. I do have a permit to sell tobacco in her area so I hope for some good news!
